USCIS extends automatic renewal of Employment Authorization (EAD)

April 4, 2024 United States Citizenship and Immigration Services (USCIS) announced an increase in the automatic extension of work authorization (EAD) in the United States. Now the work permit will be extended for 540 days (1.5 years) instead of the previous 180 days

This rule applies to applicants who can and have applied to renew their Employment Authorization Act (EAD) beginning on and after October 27, 2023 if their application is still pending.

It also applies to those who file an EAD extension on Form I-765 within the 540-day period from the date of publication of this rule in the Federal Register.

USCIS explained that the introduction of this temporary measure was necessary to prevent the expiration of work permits for 800 thousand people. These include asylum seekers, those already granted asylum, TPS status holders and green card applicants.

Otherwise, it could also negatively impact 60,000 to 80,000 US employers.
